Certificazione e cartolarizzazione della posizione beneficiaria in trust aventi oggetto finanziario
Abstract
The author’s view The certification of a beneficiary position through the issuance of a beneficiary certificate must comply with strict structural requirements to ensure the validity of the trust and the circulation of the right. The certificate is configured as a causal and nominative credit instrument that crystallizes the value of the beneficiary quota, transforming a fiduciary right into a liquid and enforceable credit, provided that the traceability of transfers is guaranteed through a beneficiary register to preserve the “certainty of objects” of the trust.
