Los delitos ambientales en el Código Penal español: regulación y cuestiones controvertidas
Abstract
This article addresses the regulation of environmental offences under the Spanish Criminal Code. In order to provide a comprehensive analysis, it underscores the growing significance of Environmental Criminal Law in a context shaped by the climate crisis and by heightened social awareness of the need to protect the natural environment, while not overlooking the existing tension with economic development objectives. The article further examines the interplay between Criminal Law and Administrative Law, which in this field proves to be unavoidable. In light of the foregoing, it argues for the need to strengthen the criminal protection of the environment.
