Sobre la adscripción al correccionalismo de Concepción Arenal. Su posición ante la Besserungsstrafe de Röder
Abstract
This interdisciplinary and historical study seeks to better understand the jurist Concepción Arenal’s alleged affiliation with the criminological school known as «Correctionalism.” Her position challenges unitary theories that perceive retribution as the essence of the diachronic nature of punishment, which she rejects as harmful in their application. This Ferrolian jurist focuses on the birth of criminology and positivist theories and adopts Krausist assumptions in support of crime prevention and the social reintegration of the offender. By making the conscience and dignity of the offender the starting point of her analysis, she anticipates later developments in the field of human rights.
