La vulneración del mandato constitucional de reinserción (a propósito de la Proposición de Ley Foral de Modificación del Estatuto de Personal al Servicio de las Administraciones Públicas de Navarra)
Abstract
the article analyzes a bill intention to modify conditions of access to the public service and the compatibility of this proposal with the reintegration mandate contained in the Spanish Constitution, with reference to the jurisprudence of the Spanish Constitutional Court and the European Court of Human Rights. The proposal is an example of the regulatory trend that seeks to restrict access to certain professions to people who, at the time, were convicted and served their sentence. This prohibition is articulated through the administrative regulation that addresses the registration of criminal records and is justified through arguments that alternate dangerousness or ethical inconvenience. This paper addresses the possible clash between the proposed regulation and the reintegration mandate that binds all Public Administrations.
