Abstract

The article 187.3 of the Spanish Criminal Code maintains in its wording the now outdated typology of sexual abuse as a possible attack on the sexual freedom of the person forced into prostitution. This is just one of the many examples of the abandonment and comparative offence suffered by prostitutes or forced prostitutes with respect to the protection of their sexual freedom. This paper deals with the non-application of the rule established in this article, by which the coercive pimp should be sentenced as the perpetrator or co-perpetrator of the crimes of sexual aggression suffered by the victim. The historical evolution of the applicable legislation will be studied. An analysis will be made of the type of crime and the possible theoretical difficulties in its application. It will conclude with a presentation of the thesis defended in this work and the conclusions obtained in it.
