O direito à nacionalidade de brasileiros por descendência na relação Brasil-Itália e suas normas de sujeição
Abstract
The work deals with the barriers imposed on Brazilians of Italian descent to obtain, since March 2025, Italian citizenship by ius sanguinis, in detriment to Decree-Law No. 36/2025 of the Italian government, which restricts nationality to a segment of descendants. The overall objective is to show how this decree-law affects thousands of Brazilians seeking nationality by descent. The specific objectives outline an overview of the prevalence of the ius solis factor due to the ease with which legalized immigrants and refugees comply with the impositions of dominant groups, as well as the absence of reciprocity, given that Brazil has always welcomed all peaceful peoples who move here, and that there is an Italy outside its borders in Brazilian territory, a consequence of the immigration legacy in the interwar period. Using a referential, qualitative, and descriptive methodology, the result is legal uncertainty brought about by the actions of the decree-law on the autonomy of the institutional pursuit of descent and naturalization, which are now denied for sociopolitical and ideological reasons.
