ОСОБЕННОСТИ ПРАВОВОГО РЕГУЛИРОВАНИЯ ОХРАНЫ И ЗАЩИТЫ ОКРУЖАЮЩЕЙ СРЕДЫ ПРИ РАЗРАБОТКЕ МЕСТОРОЖДЕНИЙ ПОЛЕЗНЫХ ИСКОПАЕМЫХ В АРКТИЧЕСКОЙ ЗОНЕ РОССИИ

В статье анализируются особенности правового регулирования охраны и защиты окружающей среды, возникающие при разработке месторождений полезных ископаемых в Арктической зоне Российской Федерации. Детально исследуется специфика применения экологического законодательства к недропользованию в уникальных условиях Арктики, включая специальные требования к процедурам лицензирования, проведению оценки воздействия на окружающую среду, разработке и реализации планов по предупреждению и ликвидации разливов нефти и нефтепродуктов, а также механизмы учета прав и интересов коренных малочисленных народов Севера. В работе выявляются ключевые проблемы правового механизма, такие как фрагментарность нормативной базы, пробелы в регулировании некоторых аспектов природопользования, сложности государственного экологического надзора и контроля в удаленных территориях, а также вопросы возмещения экологического вреда The article analyzes the specific features of legal regulation governing environmental protection and conservation arising in the development of mineral deposits within the Arctic Zone of the Russian Federation. Particular attention is paid to the application of environmental legislation to subsoil use under the unique natural and climatic conditions of the Arctic, including special requirements for licensing procedures, environmental impact assessment, the development and implementation of oil and petroleum product spill prevention and response plans, as well as mechanisms for taking into account the rights and interests of the Indigenous Small-Numbered Peoples of the North. The study identifies key problems of the legal framework, such as the fragmented nature of the regulatory base, gaps in the regulation of certain aspects of natural resource use, difficulties in exercising state environmental supervision and control in remote territories, and issues related to compensation for environmental damage
