Global Trends in Combating Air Pollution and the Universal Nature of the Right to Environment
Abstract
This study investigates the conceptual and normative foundations of environmental law with a specific focus on the human right to a healthy environment. Methodologically, the article adopts an interdisciplinary legal analysis that integrates environmental science, human rights theory, and public international law. The inquiry begins with a definitional framework of the environment as a composite of biotic and abiotic elements, followed by an exploration of its socio-legal dimensions. Ultimately, the article advances a prescriptive methodology, arguing for the recognition of an enforceable universal right to a healthy environment. This methodological design combines descriptive legal mapping with evaluative critique, proposing that sustainable governance requires a holistic integration of environmental law into the human rights system. The study thus positions itself at the intersection of environmental protection and fundamental rights, offering a framework for both academic discourse and policy-making.
