Abstract

The increasing incorporation of AI in financial reporting presents both significant opportunities and challenges. While AI promises enhanced efficiency, accuracy, and data processing capabilities, it also introduces new risks concerning liability for errors. This paper examines the potential liability risks associated with AI-driven errors in financial reporting through case-based analysis, focusing on notable examples such as the Robodebt Scheme, the Dutch Childcare Benefits Scandal, and Zillow's implementation of AI systems. Through the analyses of these case studies, we explore how AI-generated errors can lead to financial misstatements, regulatory non-compliance, and legal consequences. The study assesses the allocation of liability among stakeholders, including corporate management, auditors, AI developers, and regulators, with a focus on gaps in accountability. The findings contribute to the discourse on managing AI risks in financial reporting by proposing strategies for mitigating liability risks and calling for clearer regulatory frameworks to address AI-related errors.
