Challenges for Procedural Law Facing the Technological Globalization and Artificial Intelligence
Abstract
The advent of artificial intelligence (AI) in the legal domain, within the context of accelerated technological globalization, poses new challenges to Procedural Law. This transformation is not merely technical but also structural and axiological, as it questions classical procedural principles and necessitates to update litigants' safeguards. Simultaneously, the diversity of procedural systems in Europe complicates a coordinated response to this global phenomenon. The article—adopting a Spanish and European perspective — deeply analyzes the primary challenges and opportunities arising in this context, from technology's impact on access to justice, AI's application in judicial activities, and the management of digital evidence, to implications for procedural harmonization, fundamental safeguards, and the evolving roles of judges and lawyers in an increasingly digitalized environment. It also addresses normative and ethical proposals for responsible AI usage in judicial proceedings, considering current regulations and relevant jurisprudence in the Spanish and European contexts.
