Abstract

This chapter analyses a comparative examination of legal measures in India and the Maldives, addressing the link between human rights and climate change. In the face of climate catastrophes like global warming, cloudbursts, and dry winters, it explores judicial pronouncements and legal systems that recognise climate rights as fundamental human rights in these vulnerable nations. It studies how both judiciaries interpret and enforce constitutional and international laws to shield communities from climate impacts, highlighting India's incorporation of human rights into climate law and urging the Maldives to enhance its legal framework through specialised climate courts and global cooperation. The chapter also contributes to academic discourse and offers policy suggestions to strengthen judicial capacity in addressing complex climate-related challenges.
