What is consent?
Abstract
By giving consent, we change our rights and others’ duties—making it permissible for them to do something that was previously forbidden. To some, this ability to transform our normative situation with such a simple act has seemed “magical.” 1 Heidi Hurd writes: consent turns a trespass into a dinner party; a battery into a handshake; a theft into a gift; an invasion of privacy into an intimate moment; a commercial appropriation of name and likeness into a biography. 2
