Permitted but paid
Abstract
This chapter deals with statutory remuneration rights in copyright law. Such rights guarantee rightholders a remuneration for the use of their works, but do not allow them to make the use of their works dependent on their authorisation. The best-known example in European copyright law is the right to receive fair compensation for private copying according to Art 5(2)(b) InfoSoc Directive. After describing the characteristics of remuneration rights, this chapter focuses on the question of whether statutory remuneration rights can contribute to balancing conflicting interests in copyright law.
