Abstract

This chapter will examine the political, judicial, and legislative developments that led to some of the most progressive legislation on sexual minorities and the process of legal recognition of same-sex relationships in Africa. It will also consider the development of sexual minority rights in South Africa, from the start of campaigning through to the decriminalisation of homosexuality and subsequently the creation of same-sex marriage. Finally, the chapter will explore the arguments put forward in favour of same-sex marriage in South Africa and the scope and ambit of the Civil Union Act.
