Suspended prison sentences in Czechia
Abstract
This chapter explores the development, legal framework, and practical use of suspended prison sentences in Czechia. It traces their historical evolution from early 20th-century reforms through communist-era distortions to their current dominant role in sentencing. Suspended sentences are now widely imposed, without sufficient theoretical grounding or proportionality, contributing to sentence inflation and inconsistent penal practices. Despite being legally classified as prison sentences, they are often perceived as lenient alternatives. The chapter argues that the unprincipled expansion of suspended prison sentences has undermined their legitimacy and calls for a comprehensive reform to align sentencing with rule-of-law standards.
