Abstract

This chapter provides detailed insights into the national copyright and disability rights laws and policies of the Contracting Parties that are yet to formally implement the Marrakesh Treaty. By drawing on a range of legislative sources, constitutional provisions, and human rights treaty body reports, it provides individual profiles detailing the disability model and approach to copyright protection adopted in each non-implementing Contracting Party. Whether a disability exception is provided for in the national copyright laws of these Parties is also a central consideration. These profiles are synthesised to portray an international-scale canvas of trends in national approaches, which illustrates the link between author-centric copyright policies, individual models of disability, and restrictive approaches to disability exceptions. Overall, this chapter raises awareness of the key areas of concern and outlines recommended actions to be taken in these non-implementing Contracting Parties in a push towards the wider impact and implementation of the Marrakesh Treaty.
