Abstract

Chapter 6 revisits the EU competition law ‘agency’ acquis to establish the preconditions for the identification of integrated ‘agents’ within EU competition law. To this end, it examines how the ECJ’s and the Commission’s case law and regulatory practice have evolved through the years. Substantive scope cases are analysed in chronological order with a view to clarifying and rationalising the regulatory framework in the area and identifying the dominant trends in jurisprudence. The clarified ‘agency’ framework that will emerge at the end of this chapter will then serve as a basis for the development of a refined framework for the identification of integrated ‘workers’ within the EU competition law field in the following chapter.
