Introduction
Abstract
The approach to be defended in this study is that pragmatic, positivist, materialist and immanent approaches to the law, the scapegoat and persecution of the innocent cannot provide an insight into the nature of justice. It will, then, be maintained that there can be no justice without transcendence – a point that brings us within the purview of Emmanuel Levinas’s philosophy. Such an approach means, of course, that this work is at odds with the trend to highlight immanence in a range of contexts, not the least being in the philosophy of Gilles Deleuze, where immanence is ‘“a” life’ ( Deleuze 2001 : 27). 1
