Abstract

This chapter analyzes four strategies employed by Chinese courts to address the case-judge imbalance resulting from the “litigation explosion.” These include controlling the rise in caseload through legal/procedural adjustments and source-based governance, as well as enhancing both the number of judicial personnel and organizational efficiency to boost the court’s human resource capacity and productivity. Furthermore, the chapter focuses on the distinctive Chinese approach of trial management as a court management model, examining how the court system strives to “seek efficiency through scientific management” to tackle the issue of “high caseloads with insufficient personnel” along with the practical implications of such trial management practices.
