Exploration of Workload Measurement in Chinese Courts
Abstract
This chapter focuses on the measurement of court caseloads, exploring theories and methods to address the problem of high caseloads with insufficient personnel, primarily from the perspective of judicial demand in litigation cases. In response to the judicial capacity crisis, the U.S. court system developed the “weighted case method” as early as the 1960s. This chapter provides a brief introduction to the historical origins of this method and, on that basis, offers a systematic summary and explanation of six approaches currently used by contemporary Chinese courts to measure caseloads. It also presents practical examples illustrating the application of these caseload measurement methods.
