Abstract

The buyer’s solicitor will need to ask a number of questions of the seller as part of the process of finding out about the property. Some questions which are relevant to many Transactions are captured in a standard form. These lists of questions differ depending on the nature of the transaction. In addition to making standard enquiries, the buyer’s solicitor will also ask of the seller’s solicitor anything else they need to know about the property. Many of these questions may arise during the title investigation process or when examining search results or considering the position as regards planning permission or Building Regulations. This chapter outlines the content of the standard enquiries and explores some additional enquiries raised as part of the due diligence process. This chapter is relevant to all freehold and leasehold Transactions.
