The sale contract
Abstract
When an interest in land is disposed of, it is common for the parties to enter into a contract for the disposal of that land before the land itself is transferred. When the estate is being transferred from one party to another – for example, the transfer of the freehold or the assignment of a lease – this is done by way of the sale contract. On the grant of a lease or sub-lease, this is done by way of an Agreement for Lease. This chapter examines some of the key provisions in a sale contract. Agreements for lease are not looked at in detail.
