Consent under a lease
Abstract
Occasionally, a tenant may wish to do something with the lease premises which requires consent from the landlord, for example parting with possession (alienation) or making alterations to the premises. In Chapter 13 we explored different types of alienation and alteration provisions and the various types of covenants which determine whether consent is required for a particular activity and whether that consent must be given reasonably. In this chapter we explore the consent requirements in more detail, looking at the circumstances in which a landlord can refuse consent, as well as the process the tenant must follow to obtain consent. This chapter is relevant to commercial leases only.
