Abstract

Title investigation seeks to: establish whether the current seller has the right to sell the estate in land and can convey a legal title to the buyer; establish whether any other estates exist over the same piece of land or whether a third party has a valid interest in the land, and advise on whether the buyer will take the land subject to these; and ascertain whether the buyer requires any rights over a third party’s land in order to use the land it is purchasing. This chapter explores how to investigate title to a parcel of unregistered land. This chapter is relevant to all freehold and leasehold Transactions relating to unregistered land.
