Abstract

Artificial intelligence (AI) is the use of computer systems to perform tasks that normally require human intelligence. Generative AI creates new content, like text or images, based on patterns in data. Generative AI is revolutionizing communication, work, and innovation. The use of generative AI in forensic science poses both opportunities and challenges for the criminal justice system. The Supreme Court has adopted a new rule of evidence, FRE 707, that requires AI-generated evidence to meet the same Daubert and FRE 702 requirements for all expert testimony. The current state of forensic science AI may not be able to meet those criteria. The court system may be reluctant to admit AI-generated evidence.
