Lenovo v. IPCom: jurisdictional conflict and the approach to anti-suit injunctions in the European Union
Abstract
The court's decision and interpretation of the key principles governing ASIs, AASIs and issues of comity in Lenovo v. IPCom sit in the tradition of French courts and EU principles. Interference with the fundamental rights of access to court and of property, including intellectual property, are rarely justified. Additionally, national courts should retain full competence to decline jurisdiction if necessary and this prerogative cannot be taken away by the court of a foreign state through the use of ASI.
