Common carriage: the once, and potentially future, form of communications regulation
Abstract
Common carriage was the primary concept of communications regulation in 20th century, and it may very well be the primary concept in the future. The vintage of common carriage is likely more of an indication of its enduring strength rather than it being a weakness. In this paper, we focus on a rarely considered question: what exactly is a common carrier? Relatedly, what isn’t a common carrier? One might assume that with hundreds of years of legal precedent, the answers to these questions would be unambiguously answered. As it turns out, they are not.
