Наука в системе «человек – общество – государство»: новые подходы и решения
Abstract
This research analyzes arbitration clauses in multimodal transport contracts in international law from a comparative perspective of Uzbek and English law.Arbitration provides a unified approach to resolving disputes involving multiple modes of transport and multiple jurisdictions. The study examines theoretical models such as the sui generis, mixed, and absorbed contract theories, as well as BIMCO standards and other international conventions. The jurisdictions considered treat multimodal carriage as a single commercial operation and apply arbitration under the New York Convention, with Uzbek law recognizing the autonomy of contracts, and English law emphasizing contractual autonomy under the Arbitration Act 1996.
