ADMINISTRATIVE AND LEGAL FOUNDATIONS OF THE FUNCTIONING OF THE HIGH COUNCUL OF JUSTICE: PROBLEMS OF INSTITUTIONAL STRUCTURE AND IMPLEMENTATION OF CONTROL POWERS
Abstract
In this scientific article, the author conducts a comprehensive and multifaceted theoretical-legal study of the administrative and legal foundations of the High Council of Justice (HCJ) activities as a pivotal body within the judicial governance system of Ukraine. The relevance of the topic is driven by the ongoing transformation of the state's legal system, in which the HCJ plays a significant role in establishing the independence of the judicial branch and forming a professional and virtuous judicial corps. To date, the High Council of Justice stands as the central body mandated to ensure the impartiality and independence of the judiciary by balancing the duty to uphold judicial immunity with the exercise of integrity oversight functions. In the course of the study, several scientific methods were employed: the comparative-legal method, to trace the evolutionary transformation toward the modern High Council of Justice and to identify the primary advantages for the mechanism of contemporary personnel formation; and the systemic-structural method, used to systematize the HCJ's competence and analyze its internal structure, thereby revealing the functional roles of all auxiliary bodies. The article further analyzes the constitutional and legal status of the HCJ and defines its place within the system of state authorities. The internal architecture of the Council is disclosed in detail, including the activities of its plenary composition, the respective disciplinary chambers, as well as the secretariat and disciplinary inspectors. The procedure for the HCJ's formation and the legislative requirements for candidates are examined, highlighting the rigorous standards for competence and political impartiality.
