DIGITAL JUSTICE: THE PHILOSOPHICAL AND LEGAL DIMENSION
Abstract
It is noted that digital justice requires not only technical perfection of systems, but also their compliance with moral and ethical norms. It is aimed at overcoming new forms of inequality that arise due to unequal access to technologies and information resources. It is argued that in modern conditions, digitalization plays an important role, ensuring increased efficiency, stimulating innovative development and improving the standard of living. At the same time, there is a need to address issues of information security, equal access to technologies and compliance with ethical norms. The adaptation of society to digital changes allows for the maximum realization of the potential of digitalization and contributes to the creation of a stable and successful environment, because the modern legal system must transform from a passive instrument to an active regulator of digital relations. This involves the implementation of the principles of ethical programming and legal responsibility for the results of the work of autonomous systems.Digital justice is a form of survival of traditional legal values in a new technological order, where law is designed to guarantee that technologies will work for the benefit of man, and not vice versa. It is emphasized that the basis of all digitalization processes is a person.Nothing can replace human intelligence and the ability to think critically and analytically, as well as to show empathy and express emotions. That is why respect for human rights and freedoms is a determining factor in fair digitalization. The classical understanding of justice is today being tested by algorithmization and automation of processes. The concept of digital justice goes beyond purely technical access to the network or services; it encompasses the issue of protecting human dignity in a dehumanized digital environment, the problem of discrimination and the transparency of decision-making by artificial intelligence.
