Abstract

It is noted that the legal status of subjects of fiduciary relations determines their rights, duties and responsibilities within the framework of trust relationships established by law or contract. It is based on the principles of loyalty, good faith, honesty and prudence, which ensure the protection of the interests of the principal and a balance between personal and corporate goals. The rights of fiduciaries and beneficiaries include obtaining information, participation in management, as well as the right to profit, while the duties include compliance with standards of conduct, avoidance of conflicts of interest and liability for negligence or unlawful inaction. It is argued that fiduciary duties form the foundation of trust between participants in corporate relations. They are manifested in the legal and ethical obligation to act exclusively in the interests of another person in situations based on trust. They require the representative to exercise maximum loyalty, good faith, reasonableness and honesty in the exercise of his or her powers. It is emphasized that the peculiarity of fiduciary relations is that the duty of fiduciary loyalty is common to different types of such legal relations, although its content depends on the sphere in which they arise.Loyalty is an important component of relationships between people, manifested through respect, trust and support. This quality forms the basis of strong and healthy relationships, helps to strengthen trust and maintain mutual respect, promotes peaceful conflict resolution and joint development. The rights of the parties in fiduciary relations are determined by their legal status, but generally include the ability to receive information, participate in management and claim profit. In fiduciary relations, in particular, within the framework of a contract of agency or an act under a power of attorney, the scope of rights is determined by the specific content of the fiduciary powers, and the loss of trust may be the basis for terminating the relevant transaction. It is noted that the legal status of participants in fiduciary relationships is a key element in ensuring trust, management efficiency, and stability of economic and corporate processes, contributes to the protection of the rights of all parties, and forms the legal basis for the development of civil and corporate law.Журнал «Наукові інновації та передові технології» № 1(53) 2026 2141
