Abstract

The aim of this article is to provide an in-depth analysis of the judgment of the Court of Justice of the European Union of 26 October 2023 in Case C-307/22, with a particular focus on its implications for prisoners' rights to a free copy of their medical records. Within the context of human rights protection standards and patients' rights, access to medical documentation constitutes a crucial element enabling the exercise of numerous rights for individuals deprived of their liberty. This paper seeks to assess the extent to which the CJEU ruling may influence the interpretation and application of national regulations concerning prisoners' access to their medical history, and what potential changes in penitentiary practice may arise from this analysis. The relationship between EU law and Polish regulations in this area will be examined, as well as the potential of the CJEU judgment to strengthen the legal standing of inmates within the penitentiary system.
