Abstract

The article discusses the issue of the exclusion of prison health services from the Health Care Quality and Patient Safety Act. The basis of this study is the intervention of the Commissioner for Human Rights, who in this aspect raises doubts as to this exclusion, in the context of its compliance with the Constitution of the Republic of Poland of 2 April 1997, in particular with the principle of equal treatment by public authorities and the right to health protection and the obligation of public authorities to ensure equal access to health care services financed from public funds to citizens, regardless of their financial situation. The study attempts to answer the fundamental question of whether persons deprived of liberty, like patients of the public health care system, are guaranteed the right to the same quality of health services and full security in terms of the services provided.
