Abstract

The freedom of conscience and religion of convicts belongs to the category of fundamental rights resulting from the dignity of the human person. This method of treating convicts is defined in the Minimum Rules and the European Prison Rules, which guarantee convicts the right to practice religion and use religious services in prison. This was also confirmed in the penitentiary regulations regarding the situation of convicts in France, Germany, Spain and Sweden issued in the 20th centuary. The convicts were provided with institutionalized pastoral care and the rights of convicts in the field of freedom of conscience and religion were limited by the principles of security and order in the prison. The provisions regarding the religious freedom of prisoners are regulated not only in penitentiary laws but also in other provisions relating to the execution of prison sentences.
