Abstract

RENTAL INCOME TAX COMPLIANCE AND IDENTITY VERIFICATION ACT This legislative proposal addresses the significant federal tax gap attributable to unreported rental income by establishing a comprehensive framework for taxpayer identification verification in residential rental housing. The Act adopts a three-pillar approach balancing tax compliance objectives with civil rights protections and tenant privacy safeguards. KEY FEATURES: The proposal amends the Fair Housing Act to permit landlords to collect and verify taxpayer identification information solely for tax reporting purposes, with verification occurring only after conditional offers of tenancy. It establishes safe harbor protections for landlords who follow standardized procedures while implementing rigorous privacy requirements including federal-grade encryption, strict data use limitations, mandatory breach notification, and scheduled data destruction. The Act creates Form 1099-RENT reporting requirements parallel to existing contractor information reporting, imposes penalties for non-compliance by both landlords and tenants, and includes exemptions for owner-occupied rentals, short-term leases, and family arrangements. Implementation includes a 24-month voluntary pilot program in geographically diverse states before mandatory nationwide rollout. POLICY SIGNIFICANCE: This framework demonstrates that effective tax administration can be achieved without compromising civil liberties by establishing clear procedural safeguards, temporal separation between verification and tenant selection, and robust enforcement against discriminatory practices or data misuse. The approach draws on established precedents in employment verification, financial services compliance, and third-party information reporting while addressing sector-specific civil rights concerns unique to housing. The legislation offers a model for modern tax compliance infrastructure that leverages private sector participation while protecting individual rights, with potential applications across multiple economic sectors.
