ADMINISTRATIVE EXPROPRIATION OF ASSETS UNDER THE GUISE OF "STATE NEEDS" IN THE REPUBLIC OF KAZAKHSTAN: A systemic analysis of practice and an illustrative case of Peasant Farm "Ashamay" (KFH/KZH)
Abstract
This report is an analytical legal and policy study examining the practice of compulsory alienation of property for “state needs” in the Republic of Kazakhstan and the systemic risks arising from the conflation of legal regimes. It distinguishes between asset recovery and compulsory expropriation, demonstrating how administrative decisions may be implemented through civil-law instruments in a manner that creates an appearance of voluntariness while weakening due process guarantees. Using the documented case of the peasant farm “Ashamay” as an illustrative example, the report identifies procedural inversions, deficiencies in judicial review, risks of inadequate compensation, and barriers to effective cassation review. The report aims to clarify legal terminology, expose structural vulnerabilities, and align the analysis with international standards of property protection and the rule of law.
