Yet, by way of exception to the general rule, litigation may be affected by incidents or events that hinder or prevent its progression toward its intended objective. Such incidents or events are referred to in legal doctrine as procedural impediments to litigation (or incidents of the action). These impediments are understood as factors or occurrences that divert litigation from its normal course toward adjudication, resulting either in its suspension—whether technically or procedurally, by agreement, by operation of law, or by judicial order—or in its termination, whether by lapse, abandonment, or judgment. This raises critical questions in the context of digital litigation procedures: how will these impediments manifest within digital adjudication? What digital skills are required to manage and address them effectively? And, prior to all else, what are the nature and forms of the crises underlying these procedural disruptions?
