PEMBUKTIAN TINDAK PIDANA PENIPUAN SIBER DALAM PERSPEKTIF PASAL 378 KUHP (ANALISIS KASUS POLDA DIY)
Abstract
The development of information technology has led to a shift in fraud crimes from conventional forms to electronically based fraud. This condition raises legal issues concerning the evidentiary process of fraud offenses as regulated under Article 378 of the Indonesian Criminal Code, which was originally designed for conventional crimes. This study aims to analyze the evidentiary system of fraud offenses under Article 378 of the Criminal Code and to examine the use of electronic evidence in criminal proceedings. This research employs a normative legal research method using statutory and conceptual approaches. The findings indicate that the elements of fraud stipulated in Article 378 of the Criminal Code remain applicable to electronic-based fraud, provided that elements such as deceit or a series of lies can be proven. Electronic evidence has legal standing as valid evidence as long as it complies with the provisions of the Law on Electronic Information and Transactions. However, in judicial practice, evidentiary challenges remain, particularly regarding authentication and evidentiary strength of electronic evidence. Therefore, a comprehensive juridical understanding of digital evidence is required to ensure legal certainty and justice in handling fraud crimes.
