Legitimate Extraction: Sophisticated Laundering Hides in Plain Sight
Abstract
Abstract AML frameworks effectively detect primitive methods (cash structuring, money mules) while remaining blind to sophisticated mechanisms through which the most consequential wealth extraction occurs. This paper examines that asymmetry through five cases spanning different decades and regulatory environments. Key Arguments Fourth stage of money laundering: Beyond placement-layering-integration, hedging converts extracted wealth into activities that regulatory frameworks encourage—currency hedges, commodity futures, risk management Five case studies: BCCI, London Laundromat, Danske Bank, FTX, and Binance Dual-use problem: The same transactions constituting responsible risk management can simultaneously serve as the final step in kleptocratic extraction Panama/Pandora Papers evidence: Kazakhstan devaluations, London property opacity, derivative beneficial ownership disappearance Policy proposals: Sovereign hedging transparency, beneficial ownership verification for derivatives, calibrated due diligence Links SSRN: SSRN:6145046 ASCRI: systems.ac/2/DAI-2604 Research Lab: Dissensus AI
