Abstract
Integrating Intellectual Property Rights, Traditional Knowledge Systems, and the Evolution of Ayurveda: A Multidisciplinary Examination is a peer-reviewed review article authored by Priyanka Jadhavar, Assistant Professor, Department of Law, Shivaji University, Kolhapur, Maharashtra, India, and Ganesh Nale (Satarkar), Department of Sociology, Central University of Haryana, Mahendragarh, Haryana, India. The article is published in the Journal of Pharmaceutical Sciences (JPharmSci), an Open Access, Scopus (Elsevier) Indexed, UGC-Approved, Peer-Reviewed Journal. This article presents a comprehensive and multidisciplinary academic analysis of Intellectual Property Rights (IPR), Traditional Knowledge Systems (TKS), and the historical evolution and contemporary relevance of Ayurveda within India’s legal, cultural, and governance frameworks. The study critically examines the conceptual foundations, types, philosophy, and legal regimes of IPR, with particular emphasis on safeguarding indigenous knowledge from bio-piracy and unauthorized commercial exploitation. The article systematically explores India’s legislative and institutional mechanisms for protecting traditional knowledge, including the Patents Act, Biological Diversity Act, Traditional Knowledge Digital Library (TKDL), National Biodiversity Authority, and access and benefit-sharing (ABS) frameworks. It further situates Ayurveda within its Vedic origins, classical textual traditions, Aṣṭāṅga system, and modern institutional developments under the Ministry of AYUSH, highlighting its significance in global health and integrative medicine. In addition, the study extends its scope to criminal law, procedural systems, evidence law, and human rights, examining how legal accountability, justice administration, and constitutional protections intersect with the governance of traditional knowledge and public welfare. By integrating perspectives from law, sociology, medicine, criminology, and public administration, the article offers a holistic framework for understanding sustainable development, cultural preservation, innovation governance, and justice systems in contemporary India.
