Use of AI Systems in the Establishment of Cooperatives in Turkish Law
Abstract
In Turkish law, cooperatives are recognized as types of commercial companies. However, unlike other commercial companies, they are not specifically regulated in the Turkish Commercial Code (TCC), the main source of corporate law. Instead, the Cooperatives Code (CoC), a law specifically dedicated to cooperatives and older than the TCC in terms of its effective date, shapes the legal regime for cooperatives. An examination of the provisions in the CoC concerning the establishment of cooperatives reveals that the impact of technological advancements is only slightly felt. The role of artificial intelligence in the establishment of cooperatives is ideally possible and multifaceted. Utilizing artificial intelligence seems ideally feasible, from the preparation of the articles of association to the approval of these articles by the Ministry of Trade, to even the examination of the registration request by the Trade Registry Office to whether the request meets the conditions for acceptance. However, it must be admitted that Turkish Cooperatives Law is currently quite distant and far from this ideal.
