TITLE: THE GEOGRAPHIC GAP IN CONSTITUTIONAL HEALTHCARE: A LEGAL ANALYSIS OF THE STATE'S MANDATE IN THE ISLAND GARDEN CITY OF SAMAL
Abstract
This research concludes that the Island Garden City of Samal represents the "failure of geography" in the current legal framework of devolution. The proposed legal solution is the "Renationalization" of the island’s primary hospital. By placing the facility under the direct control and funding of the National DOH, the island can bypass the financial limitations of the local LGU. Until the "Right to Health" is bridged by physical infrastructure on the island, the constitutional promises remain nothing more than "paper rights" for the people of Samal.
