Abstract

One of the most controversial legal conflicts today is that which arises when the exercise of freedom of expression clashes with religion, either because it incites hatred, violence or discrimination on religious grounds –Islamophobia, anti-Semitism, Christianophobia or others– or because it results in offence to religious feelings. The way in which the law resolves these conflicts varies across different cultural spheres, and in a society where we live interconnected and messages are spread instantly across the internet, these differences are not trivial. Proof of this can be seen in the clashes and, on occasions, violent actions that result from this disparate understanding. This paper addresses the different legal treatment of the issue, linking it to the way human rights are conceived in: the Islamic world, Russia and other countries in Eastern Europe and Central Asia, Western Europe and the United States.
