Watching Without Warrant - NGOs, Intelligence Outsourcing, and the Grey Zones of Democratic Governance
Abstract
This article examines the emergence of non-governmental organisations (NGOs) as informal intelligence actors within contemporary liberal democracies. Drawing on theories of surveillance, intelligence outsourcing, and hybrid governance, it analyses how intelligence-like functions—such as data collection, profiling, analysis, and exposure—are increasingly delegated to or assumed by civil society organisations operating outside formal intelligence and security frameworks. Through a qualitative, multi-source case study of Researchgruppen in Sweden, complemented by comparative international examples, the study demonstrates how NGO-based intelligence activities enable states to outsource political risk, circumvent legal and constitutional constraints, and maintain plausible deniability in politically sensitive surveillance practices. The analysis shows that these hybrid arrangements blur established distinctions between state and non-state actors, activism and intelligence, and accountability and discretion. While often legitimised through public interest narratives, such practices generate cumulative democratic costs, including chilling effects on political participation, erosion of trust in civil society, and asymmetric power relations between citizens and informal intelligence actors. The article contributes to intelligence studies and democratic theory by conceptualising NGO-based intelligence as a form of shadow governance and by identifying structural accountability gaps that existing legal and oversight mechanisms fail to address. It concludes by proposing function-based oversight approaches and outlining directions for future research on informal intelligence practices and democratic accountability.
