O Erro Silencioso e a Metamorfose da Gestão de Ativos Públicos: Uma Análise Exaustiva da Transição para o Facilities Management Estratégico e a Governança Compartilhada sob a Ótica da Lei 14.133/2021
Abstract
This manuscript proposes an exhaustive investigation into the failure dynamics of physical assets under the custody of the Brazilian public administration, contrasting the deterministic laws of thermodynamics and reliability engineering with the behavioral, legal, and bureaucratic barriers that characterize contemporary state management. The central thesis postulates the existence of a "Silent Error"—a stochastic process of cumulative degradation, governed by a positive rate of change in failure rate (Δ𝜆), which is systematically ignored due to organizational psychology phenomena, specifically bureaucratic risk aversion, administrative "chronopathy," and efficiency paralysis. The study transitions from the mathematical analysis of the Bathtub Curve and the "Ghost Availability" phenomenon to the economics of administrative contracts, demonstrating how contractual fragmentation, the absence of Life Cycle Costing (LCC) analysis, and incentive asymmetry generate billion-dollar allocative inefficiencies that compromise the State's intertemporal solvency. In light of the New Bidding and Contracts Law (Law No. 14.133/2021), ISO 55000 standards, and recent federal administrative restructuring, the implementation of Shared Services Centers (CSCs) is examined, with emphasis on the ColaboraGov model and its governance established by Decree No. 11.837/2023 and Ordinance MGI No. 6.149/2025. The transition to performance-based contracts (Facilities 2.0), grounded in Result Measurement Instruments (IMR), is analyzed as the necessary structural solution to mitigate information asymmetry, restore economic rationality, and ensure the longevity of national public infrastructure in the face of the hidden maintenance backlog challenge.
