Implicit Governance Is Not Legitimacy: Why Emergent Adoption of AI Governance Architectures Remains Uninsurable
Abstract
AI systems increasingly exhibit governance-like behavior, including pre-inference controls, semantic constraints and action vetoes. These mechanisms mirror the principles formalized in A7SEM, ASOSE and ASiSO. However, implicit execution does not constitute legitimate governance. This paper demonstrates why emergent adoption remains unverifiable, unauditable and uninsurable, and why only explicit, licensed implementation converts governance behavior into institutional legitimacy.
