Abstract

AbstractThis text examines the concept of violence from a critical perspective that brings together modern political philosophy and contemporary social theory. Starting from Kant’s distinction between violentia and Gewalt, the author analyzes the state monopoly on violence in Hobbes and Weber, questioning the assumed alignment between politics, legitimacy, and the use of force. Engaging with Angela Davis, the text shifts the focus from normative justifications of violence to its experiential dimension, particularly in the context of structural racism. Drawing on the works of Galtung, Bourdieu, and Spivak, it argues that violence cannot be reduced to physical acts alone, but must also encompass structural, symbolic, and epistemic forms that shape social life. The essay thus advances a critical expansion of the concept of violence, with significant implications for legal philosophy and contemporary political conflicts. Keywords: Violence; Philosophy of Law; State; Legitimacy; Critical Theory.
