Abstract

Abstract: Educational inequalities affecting women with disabilities persist as a central challenge for the realization of the right to education and the construction of a more just society. This study focuses on a critical analysis of these inequalities in light of Marxist-feminist theory and the theory of social reproduction, using Max Horkheimer's Critical Theory of Law as a methodological foundation, which distinguishes traditional, descriptive theory from critical theory, oriented toward transformation. The research problem guiding this investigation stems from a central question: how are educational inequalities affecting women with disabilities produced and reproduced within patriarchal capitalism, how can the law act to overcome them, and what alternatives are proposed by a Marxist-Feminist Critical Theory in this context. The general objective of the study is to understand the structural mechanisms that perpetuate the educational exclusion of women with disabilities, relating gender, disability, and social class. The research methodology consists of a systematic literature review of the current state of the art, encompassing national and international academic works that address the intersection of education, disability, and gender from a critical perspective. The analysis reveals that, despite normative advances such as the 1988 Constitution and the Brazilian Inclusion Law (Law 13.146), education remains marked by barriers that reinforce the invisibility of these women and limit their full participation in a society strongly shaped by capitalist and patriarchal structures. It is concluded that integrating Marxist-Feminist Critical Theory allows for understanding educational exclusion at its core not as an isolated failure of public policies, but as a functional element in maintaining capitalist ableism, requiring intersectional policies and emancipatory educational practices that break with the established logic.
