Abstract

Resumen: This article critically analyzes gender quota fraud in Brazilian proportional elections as an expression of institutional political violence against cis and trans women. It begins with the hypothesis that fictitious candidacies are not isolated deviations, but structural mechanisms of a patriarchal system that simulates inclusion while normalizing exclusion. The methodology combines a literature review with an analysis of court decisions, electoral regulations, and legislative proposals, such as PEC 134/2015 (Brazil, Chamber of Deputies, 2015) and PLP 112/2021 (Brazil, Chamber of Deputies, 2021). It demonstrates that the current model of candidate quotas dissociates recognition from redistribution, promoting a distorted form of gender justice in which women are punished while political parties remain unaccountable. It argues that the reservation of legislative seats represents not merely a normative solution, but an epistemological shift that repositions the burden of inclusion from the individual to the structural level of the system. The article concludes that, without real redistribution of political power, legal recognition functions as a simulacrum—legitimizing the persistence of institutional electoral patriarchy.
