Abstract

A Violência Patrimonial, no entanto, apresentou certa invisibilidade tanto cientificamente, quanto no sistema jurídico. Palavras-chave: Violência Contra a Mulher; Violência Patrimonial; Sistema Judiciário. Abstract: The Maria da Penha Law (LMP) brought advances in combating violence against women, changing the punitive nature that existed in interventions. Property violence, however, has been somewhat invisible both scientifically and in the legal system. This paper seeks to discuss the presence of property violence against women in the Brazilian judicial system. A thematic analysis was conducted on 12 court decisions from the Minas Gerais Court of Justice involving domestic violence in the marital sphere and identified by the authors as containing property violence. The descriptors “domestic patrimonial violence,” “domestic violence,” “Maria da Penha Law,” and “property damage” were used in the search tool on the Court's website. Descriptions of situations with actions typical of patrimonial violence were found, but they were not named as VP, being in the presence of other types of violence that were more prominent, mainly in conjunction with psychological violence. Although it was found in 12 cases, two of which involved prohibiting women from working, VP was not mentioned in the different situations described in the decisions, being only cited among the types of violence existing in the LMP. Thus, through this study, it was possible to verify that patrimonial violence appeared secondarily in all decisions in the legal proceedings. This raises questions about how it can impact the lives of women, such as those who are unable to work, to leave their marital relationship, since they are financially limited. Even after explicit reports of domestic violence, its non-identification reflects its normalization and the lack of recognition of this violence by the judiciary. Thus, in many cases, attitudes such as preventing women from working and breaking personal belongings are not taken into account in the procedural analysis, reducing the possibilities of judicial intervention in this regard for women.
